Partner Christopher Palermo Published in Law360 on Recent Amendments to Rules in New York’s Commercial Division Courts

New York’s Chief Administrative Judge Lawrence K. Marks recently signed an administrative order amending two Rules of Practice of the Commercial Division. The amendments require that attorneys in New York’s Commercial Division courts submit statements in a form prescribed by the Office of Court Administration certifying that they have discussed with their clients the availability of Alternative Dispute Resolution options during several stages of proceedings, and to advise the Court at the preliminary conference whether their clients wish to engage in mediation at some point in the case.
Mr. Palermo, a member of the Commercial Division Advisory Council, was a primary drafter of the proposal to amend the Commercial Division rules.
