Bleakley Platt Partners Appointed to Government Transition Teams

December 2009

Bleakley Platt is pleased to announce that William P. Harrington has been appointed to the transition team of the incoming Westchester County Executive Rob Astorino. Mr. Astorino will be sworn in as County Executive on January 1, 2010, succeeding Andrew J. Spano who has served as Westchester County Executive since 1998.


The Firm is also pleased to announce that James W. Glatthaar has been appointed to the transition team of White Plains Mayor-elect Adam Bradley. Mr. Bradley, who was born and raised in White Plains, has served as an Assemblyman since 2003. He will be sworn in as Mayor on January 1, 2010 to replace Joseph M. Delfino, who retires from office on December 31, 2009.

Bleakley Platt Names Two New Partners, Jim Ausili and Michael Benenati

Bleakley Platt is pleased to announce that , effective August 1, 2009, James T. Ausili and Michael P. Benenati have become members of our Firm.


Jim represents clients in Surrogate’s Court proceedings and before the Internal Revenue Service and various state tax authorities. He advises clients in the areas of minimizing taxes and protecting assets through the use of various estate planning vehicles and post-mortem planning methods. Jim has extensive experience in the preparation of estate, fiduciary, and gift tax returns. He is a member of the Trusts and Estates Sections of the New York State and Westchester County Bar Associations, and co-chairs the Tax Section of the Westchester County Bar Association.


As a member of our Firm's Litigation, Insurance Law and Toxic Tort Practice Groups, Mike’s practice focuses on representing companies in diverse industries, including health care and manufacturing, in a broad range of commercial litigation matters, including complex contract and business tort cases, such as fraud, breach of fiduciary duty, conversion and unjust enrichment, and insurance coverage issues. His practice also focuses on representing companies in lawsuits involving product liability, environmental, mass and toxic tort, and insurance defense related matters. Mike is a member of the Association of the Bar of the City of New York, the Defense Research Institute, and Westchester County Bar Association.

Bleakley Platt Prevails in Case of First Impression on HEAL Grant Funding

July 2009

On June 30, 2009, Bleakley Platt obtained a decision by the Appellate Division, Second Department, denying plaintiffs’ motion for preliminary injunctive (PI) relief and dismissing the complaint against our Firm’s client, Orange Regional Medical Center (ORMC) with respect to the issue of whether ORMC was required to pay prevailing wage rates for all electrical contracting work being performed on ORMC’s ongoing $306 million construction project. The project will replace ORMC’s two current hospitals with a brand new, state of the art medical facility in Wallkill, New York – the first new freestanding hospital to be built in New York State in more than 20 years.


The case raises an issue of first impression concerning whether ORMC’s receipt of a $24.6 million grant from the N.Y.S. Department of Health pursuant to the Healthcare Efficiency and Affordability Law for New Yorkers (“HEAL NY”) had the effect of requiring the entire $306 million of construction work on the new hospital to be performed at prevailing wage rates or whether only the construction work funded by the HEAL Grant had to be performed at prevailing wage. Reversing the lower court, the Second Department ruled in favor of ORMC’s position that only the work funded by the HEAL Grant needs to be performed at prevailing wage rates.


The June 30 decision allows ORMC to proceed with the new medical facility construction project. BPS Partners, William M. Murphy and William P. Harrington, represented ORMC in the case with the assistance of Susan Galvao and Robert Meade. Bill Murphy successfully argued the appeal.

Among this year’s HOF inductees was Timothy J. Rooney, President of Yonkers Racing Corporation. For more than 35 years, Tim has greatly influenced the Standardbred sport as President of one of Harness Racing’s most successful tracks, Yonkers Raceway, as well as being a prominent owner and horse breeder. The Firm warmly congratulates our long-time friend and client Tim Rooney on his well-deserved election to the Harness Racing Hall of Fame.

Bleakley Platt Announces Formation of Interest Recovery Practice Group

Bleakley Platt is pleased to announce the formation of its Interest Recovery Practice Group, effective July 1, 2009. The Interest Recovery Practice will help the Firm’s corporate clients address the problem of complex and difficult to identify IRS interest computation errors and omissions on taxes and refunds or credits. These errors regularly cost individual corporations millions of dollars, which often, due to the difficulty of identifying the potential recoveries, remain unclaimed.


The Firm is also pleased to announce that Joe Incorvaia and Tim Joyce have become Members of the Firm effective July 1, 2009, and will co-head the Interest Recovery Practice Group. With experience in complex corporate tax controversies and IRS interest computations dating back to 1979, Joe and Tim have a solid understanding of the specialized technologies in the field, fluency in the complex tax transcript data that IRS interest specialists use and an up-to-date knowledge of the rules, practices and procedures that underlie IRS interest computations. William F. Harrington to Receive Thomas J. Caramadre, Jr. Humanitarian Award

William F. Harrington, Chairman of our Firm’s Executive Committee, will receive the Thomas J. Caramadre, Jr. Humanitarian Award on March 25, 2009, at the 17th Annual Yonkers Women of Excellence Awards Luncheon sponsored by The Yonkers Chamber of Commerce Women in Business Committee. This Award (which was established in memory of the late Thomas J. Caramadre, Jr., former president of the Yonkers Chamber of Commerce) is presented to an individual who has spearheaded an initiative, project or program that has benefited both the business community and the community as a whole. The Firm warmly congratulates “BJ” Harrington on his receipt of the Thomas J. Caramadre, Jr. Humanitarian Award.

Brian E. Lorenz, the head of the Firm’s Corporate Practice Group, has been nominated as one of the finalists for the “Independent Counsel of the Year Award” which is one of the awards to be issued as part of the 16th Annual Mutual Fund Industry Awards on March 19, 2009. Brian was selected for this nomination based on his accomplishments during the past year on behalf of four separate Boards at the Franklin Templeton Funds. Two New Attorneys, Joe Incorvaia and John Murphy, Join the Firm

Bleakley Platt is pleased to announce that Joseph M. Incorvaia and John J. Murphy have recently joined our Firm in the respective positions of Counsel and Associate.

Joe Incorvaia has more than 30 years’ experience in advising clients in the areas of corporate, partnership and individual business tax planning and resolution of controversies involving the calculation of interest on Federal tax obligations. He has been a guest speaker and panelist for the American Petroleum Institute Tax Section, the American Bar Association and the Tax Executives Institute. Joe received his L.L.M. degree in Taxation from the New York University School of Law and his J.D. degree from St. John’s Law School. He currently resides in Riverside, Connecticut.

John Murphy has a broad litigation background with extensive pretrial and appellate experience. His trial background has included both civil and criminal litigation, including legal malpractice, family court and real property matters. Prior to joining the Firm, John worked on complex litigations at several large Manhattan firms, and privately litigating various civil matters from eminent domain to adverse possession. He received his J.D. degree from the Fordham University School of Law, and now resides in New City, New York.

 

Bleakley Platt to Sponsor Yonkers Chamber of Commerce Networking Breakfast

Bleakley Platt is once again proud to sponsor The Yonkers Chamber of Commerce Networking Breakfast which will be held this year on Tuesday, February 24th. This year’s event will feature a presentation on the recently re-opened Intrepid Sea, Air & Space Museum after a two-year renovation and restoration project. The interior of the ship has been completely renovated with new exhibits which allow visitors to see never before seen “behind the scenes” areas, like the Foc’sle and crew quarters, allowing a new perspective as to what life was really like aboard the Intrepid.

Built in 1943, the USS Intrepid and her crew have a distinguished history of service including tours of duty in both World War II and Vietnam. The Intrepid also served as NASA’s primary recovery vessel before being retired in 1974. In 1982, the Intrepid Museum was opened to the public and has now received more than 10 million visitors.

Bleakley Platt Welcomes New T&E Attorneys to the Firm

Bleakley Platt is pleased to announce that Judy B. Brownstein and Jason G. Neroulias have recently joined our Trusts & Estates Practice Group in the respective positions of Counsel and Associate.

 

Ms. Brownstein has extensive experience in drafting of wills, trusts and other estate planning documents and in estate and trust administration and related tax issues. Prior to joining the Firm, she was a partner in a midsize Manhattan law firm and also was Of Counsel for many years to a Westchester law firm. Ms. Brownstein was the author of the 1985-1988 revision and supplement of Klipstein and Brownstein, “Drafting New York Wills,” published by Matthew Bender, Inc., and has lectured on estate planning and estate administration. She received her J.D. degree from Columbia University Law School.

 

Mr. Neroulias’ experience includes counseling clients on tax and estate planning issues, drafting wills and trusts, representing corporate and individual fiduciaries in trust and estate administration matters, and advising public charities and private foundations with respect to formation, operating procedures and compliance. He received his J.D. degree from New York Law School.
