BPS Client Prevails in Surrogate’s Court “Turnover” Proceeding
February 2013In a Bronx County Surrogate’s Court proceeding BPS client, Alan Bronstein, was accused by relatives of his former stepfather and business partner, Harry Rodman, of wrongfully obtaining Mr. Rodman’s fifty-percent interest in two renowned diamond collections, the Butterfly of Peace, 240 natural colored diamonds and the Aurora Pyramid of Hope, comprised of 296 colored diamonds. The diamond collections have been displayed at the American Museum of Natural History and the Natural History Museum in London (New York Times Article).
The Executor of the estate sought to set aside Mr. Rodman’s transfer of his fifty percent (50%) interest in the business to Alan Bronstein on the basis of alleged undue influence. After a ten-day trial, Judge Holzman concluded that there was no basis to set aside the transaction as Mr. Rodman was “intelligent, alert, responsive and had an outstanding memory,” and fully capable of understanding the transaction and viewed Mr. Bronstein as his son. The Court noted that Mr. Rodman was represented by counsel and clearly wanted Alan Bronstein (owner of the other fifty-percent of the collections), to carry on the diamond business (Link to Decision)
